Terms of Service

1. Agreement
These Terms govern your use of FomoToast’s websites, application, install script, integrations, analytics, and related services. By creating an account, purchasing a plan, or using the service, you agree to these Terms and the Privacy Policy. If you use FomoToast for a business, you confirm that you can bind that business.
2. Accounts
You must provide accurate account information, protect your password, and promptly report unauthorized access. You are responsible for activity performed through your account and for choosing who can access a shared workspace. You may not create accounts through automated or deceptive means.
3. The service
FomoToast connects supported commerce sources, turns genuine activity into website notifications, and reports visitor and Toast interactions. Current supported features are described on the Features page. Features marked “coming soon” are not part of your purchase until released.
4. Lifetime plans and limits
A lifetime plan is a one-time license to use the features and limits included in that plan for as long as FomoToast continues to operate. It is not a guarantee that the service, every integration, or every feature will exist forever. Plans currently limit monthly active visitors as shown on the Pricing page; everything else described as unlimited remains subject to normal, lawful business use and reasonable technical safeguards. When a visitor limit is reached, Toast delivery may pause until the next calendar month or until the workspace upgrades. Upgrades charge the difference between eligible plans.
5. 14-day refund policy
Your initial FomoToast plan purchase is eligible for a full refund when you request it within 14 calendar days of purchase. Email support@fomotoast.com from the purchasing account and include enough information to identify the payment. Approved refunds are returned to the original payment method and remove the related paid entitlement. Upgrade payments are also refundable within 14 days, in which case the workspace returns to the entitlement supported by its remaining paid purchases. This policy does not limit any non-waivable consumer rights.
6. Your data and customer permissions
You retain ownership of information you submit. You give FomoToast the limited right to host, process, transform, and display it as needed to provide the service. You are responsible for having permission and a lawful basis to send customer commerce information to FomoToast, for configuring truthful messages, and for giving website visitors any notice or consent required for local storage and analytics.
7. Acceptable use
You may not use FomoToast to:
- fabricate purchases, subscriptions, customers, locations, or other social proof;
- publish misleading scarcity, impersonate another person, or misrepresent an event source;
- collect or expose payment credentials, passwords, health data, government identifiers, or other highly sensitive data in Toast messages;
- violate privacy, consumer-protection, intellectual-property, sanctions, or other applicable laws;
- probe, disrupt, overload, scrape, reverse engineer, bypass plan limits, or interfere with the service or another account;
- send malware, abusive traffic, or content that is unlawful, threatening, or fraudulent.
8. Integrations
Stripe, WooCommerce, Cloudflare, Neon, and other third-party services are governed by their own terms. Their availability, APIs, and decisions are outside FomoToast’s control. You authorize FomoToast to exchange the data needed for integrations you connect, and you can disconnect them from your workspace.
9. Suspension and termination
You can stop using FomoToast and delete your account at any time. We may limit or suspend access when reasonably necessary to address security risk, non-payment, unlawful use, abuse, a serious Terms breach, or harm to the service or others. Where practical, we will provide notice and an opportunity to correct the issue. Sections that by nature should survive termination—including payment, ownership, disclaimers, and liability terms—continue to apply.
10. Intellectual property
FomoToast and its software, visual design, trademarks, and documentation belong to the service operator and licensors. These Terms grant only a limited, non-exclusive, non-transferable right to use the service. Feedback may be used to improve FomoToast without an obligation to you.
11. Service changes and availability
We work to keep FomoToast dependable, but do not promise uninterrupted or error-free operation. We may fix, replace, add, or retire features and integrations. If a change materially reduces a paid plan’s core value, we will try to provide reasonable notice or a practical alternative.
12. Disclaimers
FomoToast is provided “as is” and “as available” to the extent allowed by law. We do not guarantee increased sales, conversions, revenue, or any particular business result. You remain responsible for your website, offers, messages, legal compliance, and business decisions.
13. Limitation of liability
To the maximum extent permitted by law, FomoToast and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Total liability arising from the service will not exceed the amount you paid FomoToast during the 12 months before the event giving rise to the claim. Nothing here excludes liability that cannot legally be excluded.
14. General terms
If a provision is unenforceable, the remainder stays effective. A delay in enforcement is not a waiver. You may not transfer these Terms without consent; we may transfer them as part of a reorganization or sale. Applicable mandatory law and courts govern disputes where the law requires; otherwise, the law applicable to the FomoToast operator governs.
15. Changes and contact
We may update these Terms as FomoToast changes. Material updates will be communicated through the service or by email where appropriate. Questions and refund requests can be sent to support@fomotoast.com.
